Terms of Service

These Terms of Service ("Terms") govern your access to and use of the exchangerate.dev API, website, documentation, MCP server, and related services (the "Service"), operated by Nusantara Ventures, LLC ("we", "us", "our"). By creating an account, issuing an API key, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The data, indicative reference, not a source of record

The Service provides indicative, developer-grade reference exchange rates derived from live market data and public reference rates. These rates are not official, bank-grade, interbank, or settlement rates, and are not a source of record. Live rates are indicative and may differ from interbank rates (typically on the order of 5–15 basis points, and more on weekends and outside major-market hours). Daily reference rates include figures published by public institutions (for example, central-bank reference rates), attributed where applicable.

Free, keyless callers, and our website receive live rates 15 minutes late; paid plans receive the same feed live. ECB daily reference rates are published once daily without delay for anyone. The Free plan has no WebSocket stream.

You must not use the data for: trade execution, clearing or settlement, regulatory or financial reporting, benchmark or index construction, or any purpose requiring authoritative or official rates. The data is provided for informational and developer-integration purposes only.

2. Acceptable use

You agree not to, and not to permit others to:

• use the data for any purpose prohibited in Section 1;
• resell, redistribute, sublicense, or otherwise pass on raw or derived rate data through your own API, SDK, data feed, file export, or dataset. No plan allows this; reselling requires a separate written agreement via hello@exchangerate.dev. Paid plans allow display to your own end users on your own website or app, including commercially, with no credit required;
• display rates on the Free plan on your own website or app, including commercial products, without a visible link reading "Rates by Exchangerate.dev" to https://exchangerate.dev on any page or screen that shows the data;
• exceed the rate limits or call volumes of your plan, or circumvent quota, authentication, or billing;
• scrape, bulk-export, or mirror the Service beyond your plan's documented limits;
• use the Service to build a product that is substantially a competing rate-data feed;
• reverse-engineer, interfere with, or attempt to gain unauthorized access to the Service or its infrastructure.

3. Accounts and API keys

You are responsible for safeguarding your API key and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or revoke keys that violate these Terms or threaten the Service.

4. Plans, billing, cancellation, and refunds

Paid plans are billed monthly or yearly via our third-party payment processor. Metered overage applies only where you have opted in; free-tier limits are hard-capped. You may cancel at any time, effective at the end of the current billing period; your account then downgrades to the free tier. We will not impose retroactive price increases on your existing plan, and any price change applies with at least 30 days' notice. Taxes may apply based on your location and are your responsibility.

No refunds. Paid fees are non-refundable, including for partial billing periods, except where non-waivable consumer-withdrawal or refund rights apply in your jurisdiction. In cases of serious service disruption materially affecting your use, we may offer a goodwill accommodation at our sole discretion; refunds remain subject to the exceptions above. Credits and refunds are not automatic. Any service credit is at our discretion under section 7.

5. Availability

The Service is provided on a best-effort basis with no service-level agreement (SLA) at this time. We publish a status page at /status but do not guarantee uptime, latency, or uninterrupted availability. We may modify, suspend, or discontinue any part of the Service. Credits are not automatic; any service credit is at our discretion under section 7.

6. Disclaimers

THE SERVICE AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, TIMELINESS, OR NON-INFRINGEMENT. We do not warrant that the rates are accurate, current, or suitable for any purpose. You are solely responsible for any decisions or actions taken based on the data.

7. Limitation of liability

Nusantara Ventures, LLC operates exchangerate.dev. To the extent the law allows, service credit is your sole and exclusive remedy for any failure of exchangerate.dev or its data. Credits provide up to 3 free months of your current paid plan in any 12 months. Any credit is given at our discretion and is never automatic. Free-plan users receive no credits. We provide no cash reimbursement. Credits are not cash, cannot be transferred, and expire when your account closes. We exclude liability for indirect or consequential losses, lost profits, and lost data. We also exclude liability for losses from trading, investment or other financial decisions made using the data, and for downstream consequences of those decisions. If money claims remain available, our total liability for all claims relating to exchangerate.dev is limited to the fees you paid for exchangerate.dev in the 12 months before the claim. Nothing limits liability that cannot be limited by law, including non-waivable consumer rights.

8. Indemnification

You will indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service or your breach of these Terms, including any use of the data prohibited in Section 1.

9. Third-party services and subprocessors

The Service relies on third-party providers for payment processing, hosting, database, caching, content delivery, transactional email, and error monitoring. A current list of subprocessors is maintained at /privacy/subprocessors and updated when providers change. Each third-party service is governed by its own terms; we are not responsible for third-party outages, data incidents, or policy changes, though we take reasonable steps to maintain continuity.

10. Changes

We may update these Terms. Material changes will be posted with an updated effective date; continued use after changes take effect constitutes acceptance.

If your account was created before 2026-10-08, you keep the data-use terms you accepted at signup while you stay on your current plan, unless you choose these terms instead. The first 2026-10-08 text, in effect until 07:18 UTC that day, remains at /terms/archive/2026-10-08. The text revised at 07:18 UTC remains at /terms/archive/2026-10-08-revised, and its second revision that day remains at /terms/archive/2026-10-08-revised-2. The text revised on 2026-10-09 remains at /terms/archive/2026-10-09, and the text revised on 12 October 2026 remains at /terms/archive/2026-10-12. The version before them remains at /terms/archive/2026-07-06.

11. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. The courts of the State of Delaware, United States have exclusive jurisdiction over any dispute, subject to any mandatory consumer protections in your place of residence.

12. Miscellaneous

Severability. If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect. No waiver. Our failure to enforce any provision is not a waiver of future enforcement. Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
