These Terms of Service ("Terms") govern your access to and use of the exchangerate.dev API, website, documentation, MCP server, and related services (the "Service"), operated by Nusantara Ventures LLC ("we", "us", "our"). By creating an account, issuing an API key, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The data — indicative reference, not a source of record

The Service provides indicative, developer-grade reference exchange rates derived from aggregated market data and public reference rates. These rates are not official, bank-grade, interbank, or settlement rates, and are not a source of record. Live rates are indicative and may differ from interbank rates (typically on the order of 5–15 basis points, and more on weekends and outside major-market hours). Daily reference rates include figures published by public institutions (for example, central-bank reference rates), attributed where applicable.

You must not use the data for: trade execution, clearing or settlement, regulatory or financial reporting, benchmark or index construction, or any purpose requiring authoritative or official rates. The data is provided for informational and developer-integration purposes only.

You are responsible for safeguarding your API key and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or revoke keys that violate these Terms or threaten the Service.

4. Plans, billing, cancellation, and refunds

Paid plans are billed monthly via our third-party payment processor. Metered overage applies only where you have opted in; free-tier limits are hard-capped. You may cancel at any time, effective at the end of the current billing period; your account then downgrades to the free tier. We will not impose retroactive price increases on your existing plan, and any price change applies with at least 30 days' notice. Taxes may apply based on your location and are your responsibility.

No refunds. Paid fees are non-refundable, including for partial billing periods, except where non-waivable consumer-withdrawal or refund rights apply in your jurisdiction. In cases of serious service disruption materially affecting your use, we may offer a goodwill accommodation at our sole discretion; no automated credit or refund scheme applies.

5. Availability

The Service is provided on a best-effort basis with no service-level agreement (SLA) at this time. We publish a status page at /status but do not guarantee uptime, latency, or uninterrupted availability. We may modify, suspend, or discontinue any part of the Service.

THE SERVICE AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, TIMELINESS, OR NON-INFRINGEMENT. We do not warrant that the rates are accurate, current, or suitable for any purpose. You are solely responsible for any decisions or actions taken based on the data.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR THE DATA. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including any non-waivable rights you have as a consumer.

8. Indemnification

You will indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service or your breach of these Terms, including any use of the data prohibited in Section 1.

9. Third-party services and subprocessors

The Service relies on third-party providers for payment processing, hosting, database, caching, content delivery, transactional email, and error monitoring. A current list of subprocessors is maintained at /privacy/subprocessors and updated when providers change. Each third-party service is governed by its own terms; we are not responsible for third-party outages, data incidents, or policy changes, though we take reasonable steps to maintain continuity.

10. Changes

We may update these Terms. Material changes will be posted with an updated effective date; continued use after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. The courts of the State of Delaware, United States have exclusive jurisdiction over any dispute, subject to any mandatory consumer protections in your place of residence.

12. Miscellaneous

Severability. If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect. No waiver. Our failure to enforce any provision is not a waiver of future enforcement. Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
